2. Identify the dispute surface (Decision Point 1)

Place the dispute on one of three tracks. Statutory pay disputes (SPP, SAP, ShPP entitlement or amount) go to HMRC's Statutory Payments Disputes Team and are appealable to the First-tier Tribunal (Tax Chamber). Refused leave or refused booking notices go to the Employment Tribunal. Detriment or automatically-unfair dismissal for taking or seeking SPL is an ERA 1996 §99 claim, also in the Employment Tribunal but on a different cause of action.
