Penalties for CDM breaches

CDM breaches are criminal offences.

Offence: Contravening any CDM 2015 requirement, or a requirement of an improvement or prohibition notice (HSWA 1974 s33)
Summary conviction, England and Wales: Unlimited fine and/or up to 12 months' imprisonment
Summary conviction, Scotland: Fine up to £20,000 and/or up to 12 months' imprisonment
Conviction on indictment: Unlimited fine and/or up to 2 years' imprisonment
Directors and managers: Personally guilty if the offence involved their consent or connivance, or their neglect
Enforcing authority: Health and Safety Executive by default; Office for Nuclear Regulation on GB nuclear sites; the fire and rescue authority for fire matters on a site inside occupied premises

The same maximum penalties apply to breaches of CDM 2015 duties and to failing to comply with an improvement notice or prohibition notice.
