Offences and prohibitions 4

Fail to provide or disclose information required by Highlands and Islands Enterprise

Unlimited fine

If a business or any person in the Highlands and Islands does not give the information that Highlands and Islands Enterprise asks for (or gives false information), or discloses that information to anyone else without permission, they commit a criminal offence. The offence can be tried in either the magistrates’ court or Crown Court and can result in an unlimited fine. No imprisonment is specified for these breaches.

Fail to provide or give false information to Scottish Enterprise

Unlimited fine

If you are asked in writing by Scottish Enterprise to confirm who has an interest in any premises you occupy or let, you must reply within 10 days. Refusing to reply, missing the deadline, or supplying information you know is false is a criminal offence. Conviction can lead to an unlimited fine (or up to £1,000 for a simple refusal) and the case may be tried in either the Magistrates’ Court or Crown Court.

Use disclosed information beyond permitted purpose

Unlimited fine

If you receive statistical information under this section and then use it for any purpose other than those expressly allowed (e.g. research, planning, or the specific purpose set out in the notice), you commit a criminal offence. Conviction brings a summary‑only fine up to level 5 on the standard scale (an unlimited fine). There is no custodial sentence.

Wilfully obstruct an authorised entry

Fine up to £1,000

If you deliberately block or prevent a person who has written authority from Scottish Enterprise or Highlands and Islands Enterprise from entering land to carry out a survey, you commit an offence. On conviction in the Magistrates’ Court you face a fine of up to £1,000 (Level 3 on the standard scale). No jail term is provided for this offence.
