Operating without a licence

Important: hire or reward definition

Hire or reward means carrying goods for payment or other consideration, including:

Haulage for customers
Courier and delivery services for third parties
Contract logistics for other businesses
Any carriage where goods owner is not the vehicle operator

If you carry any third-party goods, even occasionally, you need a Standard licence. Restricted licences are strictly for own goods only.

Operator licence fees consist of an application fee, a fee for each vehicle, and ongoing annual vehicle fees. Continuation fees are payable every 5 years to maintain the licence. Fees are the same for Standard International and Standard National licences, with lower continuation fees for Restricted licences.

Financial Standing Requirements for Operator Licences

Minimum capital requirements for Standard and Restricted operator licences with evidence requirements.

All operator licence applications must demonstrate financial standing—sufficient financial resources to operate safely and maintain vehicles properly. The required amount depends on licence type and number of vehicles. Must provide evidence of funds held for 28 consecutive days within 2 months of application.

Standard International/National - first vehicle: £8,000
Standard International/National - each additional: £4,500
Restricted - first vehicle: £3,100
Restricted - each additional: £1,700
Evidence period required: 28 consecutive days
Evidence date requirement: Within 2 months of application

Providing financial standing evidence

Must provide one of the following:

Bank statements: Showing required amount for 28 consecutive days, dated within 2 months of application. Most common method.
Audited accounts: Latest audited accounts showing net current assets or working capital exceeding requirement. Suitable for established limited companies.
Accountant's letter: Letter from qualified accountant confirming available funds, dated within 2 months of application. Must specify exact amount available.

Funds must be unencumbered (not already committed to other purposes). If using bank statements, all pages must be provided showing continuous period.

Ongoing financial standing

Must maintain financial standing throughout the life of the licence. If financial standing falls below required level:

Must notify Traffic Commissioner immediately
Given 6 months to remedy the situation
Failure to restore financial standing results in licence revocation
Cannot add vehicles without demonstrating financial standing for additional vehicles

Transport Manager Certificate of Professional Competence (CPC)

All Standard International and Standard National operator licences must nominate a Transport Manager who holds a Certificate of Professional Competence (CPC). The Transport Manager must exercise genuine continuous control over the transport operation. CPC is NOT required for Restricted licences.

Load security: Ensuring vehicles loaded safely and within weight limits

Transport Managers can manage multiple operator licences, but Traffic Commissioners assess whether genuine continuous control is possible based on fleet size, geographic spread, and TM availability.

Requirements for operating centres including planning permission, parking capacity, maintenance facilities, and environmental conditions.

All operator licences require at least one operating centre—a secure site where authorised vehicles are normally kept when not in use. Operating centres must have planning permission for commercial vehicle operations, adequate parking for all authorised vehicles, and access to maintenance facilities.

Planning permission required: B8 (storage/distribution) or Sui Generis use class
Parking capacity: Must accommodate all authorised vehicles
Overnight parking: All vehicles must park within operating centre (not on public roads)
Environmental hours restrictions: Often restricted to 07:00-19:00 Mon-Sat (varies by local authority)

Planning permission for operating centres

Most operating centres require planning permission for commercial vehicle operations. Typical use classes:

B8 (Storage and Distribution): Most common for operating centres. Covers warehouses, distribution centres, and goods vehicle parking.
Sui Generis: Some vehicle operations (particularly larger fleets or HGV parking) fall outside standard use classes and require specific Sui Generis planning permission.
Existing use rights: Some sites have established use rights for vehicle operations. Planning history search recommended.

Check with local planning authority before committing to a site. Planning permission applications can take 8-12 weeks. Operating without planning permission can result in enforcement action and licence revocation.

Environmental impact and objections

When you apply for an operator licence, local residents and authorities can object if concerned about:

Noise: Vehicle movements, refrigeration units, loading/unloading
Air quality: Emissions from vehicles, particularly in residential areas
Traffic: Increased HGV movements on local roads
Hours of operation: Early morning or late night operations
Road safety: Access arrangements, visibility, pedestrian safety

Traffic Commissioners can impose conditions limiting hours of use, numbers of vehicle movements, or types of operations. Serious objections may result in licence refusal or requirement for alternative operating centre.

Maintenance facilities

Must have access to suitable facilities for vehicle inspections and maintenance:

On-site facilities: Inspection pits, vehicle lifts, workshop equipment. Most suitable for larger operators.
Contract maintenance: Arrangement with authorised workshop for safety inspections and repairs. Suitable for smaller operators. Must provide written agreement from contractor.
Mobile inspection: Some operators use mobile inspection services visiting the operating centre. Must still have suitable hard standing for inspections.

Must demonstrate how 6-weekly or 10-weekly safety inspections will be conducted and recorded.

Varying Your Operator Licence (Adding Vehicles, Changing Operating Centres)

Process for varying existing operator licences to add vehicles, change operating centres, or update Transport Managers.

Operator licences can be varied to add or remove vehicles, change operating centres, or update Transport Managers. Minor variations (adding vehicles within headroom) are processed immediately. Major variations (increasing authorisation, changing operating centres) require consultation and take 9-12 weeks.

Log into VOL account: Go to www.gov.uk/vehicle-operator-licensing and sign in with Government Gateway credentials. Access your operator licence dashboard showing current authorisation, specified vehicles, and operating centres.
Check licence headroom before adding vehicles: Headroom = authorised vehicles minus specified vehicles (e.g., 5 authorised, 3 specified = 2 headroom). Can add vehicles immediately if within headroom with no variation needed. If no headroom, must apply for variation to increase authorisation.
Add vehicle within headroom (immediate): Select 'Add Vehicle' from VOL dashboard. Enter vehicle registration, make, model, gross plated weight. Upload V5C registration document. Pay annual vehicle fee (£59). Licence disc generated immediately for printing and display in vehicle windscreen.
Apply for variation to increase authorisation: If no headroom available, select 'Apply to vary licence'. Specify number of additional vehicles needed.
