What you must do
7 compliance obligations under this legislation.
Other requirements 1
Confirm acceptance of cost estimate before work starts
If you apply to the ONR or a licensing authority for work that will be charged on the basis of the reasonable cost to the authority, you must first receive a written estimate and then confirm that you want the work carried out on that basis. Your business cannot proceed until you give this acceptance.
Payments and fees 6
Pay fee for HSE intervention when notified
If an HSE inspector tells you in writing that you have breached a biocidal product regulation, you must pay a fee to cover the inspector’s work. The fee also applies to any on‑site inspection where the inspector forms the same opinion. The amount is set out in this regulation and regulation 24.
Pay fees for employee medical examinations or surveillance
When you arrange a medical check‑up or ongoing health surveillance for your staff (or, if you’re self‑employed, for an asbestos‑related check), you must pay a basic fee to the Executive, plus any extra charges for X‑rays or lab tests as set out in Schedule 4. The amount is fixed by the schedule and must be paid each time the examination or surveillance is carried out.
Pay fees for offshore first‑aid and medical training approvals and site visits
When you apply for, renew or maintain an approved offshore first‑aid or offshore medical training programme, you must pay the fees set out in the regulations. You also have to pay any extra fees if the HSE asks for additional site visits, investigations of complaints, or if you cancel a scheduled site visit at short notice. All fees must be paid within 30 days of the invoice (or before the outcome is notified where the regulation requires it).
Pay fees for regulatory enforcement of onshore wind projects
If your business commissions an onshore wind energy installation (the client) you must pay a fee to the regulator for any enforcement work the regulator or its inspectors carry out during construction. Likewise, if you operate an onshore wind installation you must pay a fee for enforcement work related to the operation of the site.
Pay fees for regulatory enforcement of your pipeline
If you own or operate a pipeline (including major‑accident‑hazard pipelines), you must pay a fee to the Executive for any enforcement inspections or actions they carry out on your pipeline or on contractors working on it, unless a fee is already covered under another regulation. The fee is due when the Executive or its appointed inspector performs those enforcement functions.
Pay ONR fees for nuclear site work and enforcement
If your business holds a nuclear site licence, you must pay a fee to the Office for Nuclear Regulation whenever it carries out assessments, inspections or enforcement actions on your site (or on work carried out by your contractors). The fee is invoiced by the ONR and must be settled as required.
