The Third Parties (Rights Against Insurers) Act 2010 allows a third party with a liability claim against an insured person or company (that has become insolvent) to step into the insured's shoes and claim directly against the insurer. Enforcement is exclusively via civil litigation by the third-party claimant in the courts; the FCA regulates the insurer but does not enforce the statutory rights created by this Act on behalf of individual claimants. There is no public regulator with powers to enforce compliance with the 2010 Act.
