Apply to High Court within six weeks if you want to challenge a planning document

If a planning strategy, plan or other relevant document (for example a local development plan or the Mayor of London’s spatial development strategy) harms your business, you can only dispute it in court by first getting the High Court’s permission. You must make that application within six weeks of the document’s publication or adoption date.

Offences and prohibitions 2

Continue activity after a temporary stop notice

Unlimited fine

If a local planning authority serves a temporary stop notice on you (or displays it on the land) and you keep carrying out the activity that the notice prohibits, you commit a criminal offence. On conviction you face a fine – up to £20,000 in a magistrates’ court, or an unlimited fine if tried in the Crown Court.

Fail to comply with compulsory purchase information notice

Unlimited fine

If a compulsory purchase authority serves you with a notice asking for details of who owns, leases or otherwise has an interest in a particular piece of land, you must supply that information in writing within the period set (at least 14 days). Ignoring the notice without a reasonable excuse, or deliberately giving false information, is a criminal offence. On conviction in the magistrates' court you face an unlimited fine.
