Journey Step 2 of 5
Decide which regime applies to your workforce
First decision: HSCER or SRSCR?
Get this wrong and the rest of your consultation effort sits on a flawed foundation. SRSCR 1977 covers employees represented by a safety representative appointed by a recognised trade union; HSCER 1996 covers everyone else. In a partly unionised workplace, both regimes operate side by side — SRSCR for the union-represented employees, HSCER for the rest. The disambiguator guide below works through the realistic scenarios, including the case where a union is recognised but has not appointed a safety representative.
Working out which safety consultation regime applies: HSCER 1996 or SRSCR 1977
Work out which regime covers which employees, including the partly-unionised case and the "recognised union but no appointed rep" edge case.
