Why NI employment law differs from Great Britain
Employment law is a devolved matter in Northern Ireland. While many principles are similar to GB, the legislation is separate and there are significant differences. Northern Ireland has its own employment tribunals, its own equality legislation, and unique obligations such as fair employment monitoring that have no equivalent elsewhere in the UK.
This learning path covers the key areas where NI employers face different or additional obligations.

Step 2: Understand which GB reforms apply in NI
Not all Westminster employment legislation extends to Northern Ireland. The Employment Rights Act 2025 is a significant example: many of its provisions do not apply in NI unless the NI Assembly passes equivalent legislation. As an NI employer, you need to know which reforms affect you and which do not.
Step 3: Register for fair employment monitoring
Fair employment monitoring is Northern Ireland's most distinctive employment requirement. All employers with more than 10 employees must register with the Equality Commission for Northern Ireland and monitor the community background and sex of their workforce. This obligation has no equivalent anywhere else in the UK.

Step 4: Meet NI equality obligations
Northern Ireland has its own equality framework, separate from the Equality Act 2010 which applies in GB. The NI framework is spread across multiple pieces of legislation and includes protections not found in GB law, as well as some gaps where GB protections have not been replicated.

Step 5: Know where to get help
Northern Ireland has its own employment dispute resolution body, the Labour Relations Agency, which provides the equivalent services to Acas in Great Britain. If you face a tribunal claim or need to resolve a workplace dispute, the LRA should be your first port of call.
