Understand why care regulation differs across the UK

Health and social care is a devolved matter across the United Kingdom. Each nation has its own inspectorate, its own registration regime, and its own quality standards. There is no single UK-wide care regulator and no automatic mutual recognition of registrations between nations. If you operate or plan to operate in more than one nation, you must comply separately with each.

Four nations, four inspectorates

England is regulated by the Care Quality Commission (CQC), Scotland by the Care Inspectorate, Wales by Care Inspectorate Wales (CIW), and Northern Ireland by the Regulation and Quality Improvement Authority (RQIA). Each body operates under different primary legislation, applies different quality frameworks, and runs its own inspection cycle. A registration with one does not grant permission to operate in another nation.

The three devolved care inspectorates regulate social care services under separate legislation with distinct approaches to registration, inspection, and enforcement. Understand cross-border registration requirements

Each nation requires a separate registration before you can deliver regulated care services within its borders. The registration criteria, timelines, fees, and evidence requirements differ between inspectorates. Expanding into a new nation means starting a fresh registration process, not simply notifying your existing regulator.

Separate registrations for each nation

A provider registered with CQC in England must apply separately to the Care Inspectorate if expanding into Scotland. The same applies in every direction. Each regulator will assess your fitness to provide services under its own legislation and standards. Allow several months for each new registration, particularly where premises inspections are required.

Social care regulation is fully devolved across the United Kingdom. Each nation has its own care inspectorate, its own founding legislation, and its own registration regime. There is no mutual recognition of registration between any of the four nations.

A provider operating care services in more than one UK nation must submit separate applications to each inspectorate, pay separate fees, satisfy separate fitness-to-practise and premises requirements, and undergo separate inspections under different quality frameworks. Service type definitions differ between jurisdictions, so a service classified as one type in England may fall under a different category elsewhere.

Workforce registration bodies are also nation-specific. Staff must be registered with the relevant body for the nation in which they work: Social Work England (SWE) for England, the Scottish Social Services Council (SSSC) for Scotland, Social Care Wales for Wales, and the Northern Ireland Social Care Council (NISCC) for Northern Ireland. Staff transferring between nations must re-register with the new nation's body.

Operating without registration is a criminal offence in every UK nation. Do not deliver regulated services in a new nation until your registration with the relevant inspectorate is confirmed. Enforcement powers vary, but unregistered providers can be prosecuted in all four nations (in Scotland, prosecutions are brought by the Crown Office and Procurator Fiscal Service rather than the Care Inspectorate itself).

Manage workforce portability across borders

Staff qualifications, professional registration, and criminal record disclosure requirements differ between UK nations. Moving staff across borders or recruiting from another nation requires careful attention to whether their qualifications and checks are recognised, and what additional steps you must take before they can work in a new jurisdiction.

Disclosure schemes and workforce registration

England and Wales use the Disclosure and Barring Service (DBS), Scotland uses Disclosure Scotland and the Protecting Vulnerable Groups (PVG) scheme, and Northern Ireland uses AccessNI. These schemes are not interchangeable. A DBS check does not satisfy Scottish PVG requirements. Similarly, workforce registration bodies such as Social Care Wales, the Scottish Social Services Council (SSSC), the Northern Ireland Social Care Council (NISCC), and Social Work England each maintain separate registers with different registration requirements.

Each UK nation has its own mandatory workforce registration body for social care staff. Registration with one body does not transfer automatically to another nation. Staff moving between nations must apply to the new nation's body and meet its specific requirements.

Qualification recognition: Qualifications obtained in one UK nation are generally accepted by other nations' registration bodies, but this is not guaranteed. Each body makes its own assessment of whether qualifications meet its standards. Staff may need to complete additional training or demonstrate equivalent competence.

Disclosure and barring: Criminal record check schemes are also nation-specific. The DBS (Disclosure and Barring Service) operates in England and Wales, Disclosure Scotland operates the PVG (Protecting Vulnerable Groups) scheme in Scotland, and AccessNI operates in Northern Ireland. There is no automatic cross-border portability between any of these schemes. The DBS Update Service allows portability within England and Wales only and does not extend to Scotland or Northern Ireland.

Employers with cross-border staff: If you employ staff who work across national borders, you must ensure each worker is registered with the correct workforce body and holds valid disclosure checks for each nation in which they provide care. This may require maintaining multiple registrations and disclosure checks for the same individual.
