How to use this checklist

Work through each section and answer yes or no for your reservoir. Any "no" is a compliance gap that needs action now. If you are an undertaker for more than one reservoir, complete the checklist for each one separately.

This checklist assumes your reservoir meets the registration threshold for your nation. Confirm that first.

1. Registration

  1. Reservoir is registered with the enforcement authority

    Yes / No. England and Wales: Environment Agency or Natural Resources Wales. Scotland: SEPA. Northern Ireland: Department for Infrastructure (DfI).

  2. Registration was completed within the statutory notice period after first impounding

    Yes / No. Confirm the registration notice was filed on time and a copy is held on file.

  3. Authority register entry shows the correct undertaker, capacity, and contact details

    Yes / No. Check that any change of ownership, name, or address has been notified.

  4. Reservoir capacity has been confirmed against the threshold for your nation

    Yes / No. Re-measure if there has been any alteration that could change capacity.

2. Engineer appointments

  1. A panel-qualified supervising engineer is currently appointed in writing

    Yes / No. Appointment letter is on file and the engineer is on the current Defra panel (or SEPA-recognised panel in Scotland).

  2. A panel-qualified inspecting engineer was appointed for the most recent statutory inspection

    Yes / No. The inspecting engineer must be a different person from the supervising engineer.

  3. A construction engineer is appointed if any construction, alteration, or enlargement is in progress

    Yes / No. If no works are in progress, mark not applicable.

  4. Replacement engineers are appointed within 28 days of any vacancy

    Yes / No. Check that there has been no gap in supervising engineer cover.

3. Inspection cycle

  1. The most recent statutory inspection took place within the last 10 years

    Yes / No. Earlier if the previous inspecting engineer specified a shorter interval.

  2. All "measures to be taken in the interests of safety" from the last inspection have been completed by their deadlines

    Yes / No. List any outstanding measure with the original deadline and a revised completion date.

  3. An annual written statement from the supervising engineer has been received for each year since the last inspection

    Yes / No. Statements are dated, signed, and held on file.

  4. The next inspection is diarised at board level with at least 6 months' lead time for engineer appointment

    Yes / No.

4. On-site flood plan

  1. A current on-site flood plan is in place and accessible at the reservoir

    Yes / No. England undertakers must have one for high-risk reservoirs.

  2. The plan has been reviewed within the last 12 months

    Yes / No. Reviews should also follow any inspection, alteration, or change of undertaker.

  3. Named roles, contact details, and out-of-hours numbers in the plan are current

    Yes / No.

  4. The plan has been shared with the local authority or resilience partnership preparing the off-site plan

    Yes / No.

  5. At least one tabletop or live exercise has been carried out in the last 3 years

    Yes / No.

5. Undertaker duties and incident reporting

  1. A clear single point of accountability for undertaker duties is identified at board or owner level

    Yes / No. Name and role recorded.

  2. Procedures are in place to report any incident, near-miss, or unusual behaviour to the supervising engineer without delay

    Yes / No.

  3. Procedures are in place to notify the enforcement authority of any reportable incident

    Yes / No. England and Wales: Environment Agency / NRW. Scotland: SEPA. Northern Ireland: DfI Reservoirs.

  4. The enforcement authority has been notified in advance of any planned construction, enlargement, alteration, or abandonment

    Yes / No. Mark not applicable if no such works are planned.

6. Records

  1. A complete prescribed form of record is maintained at the reservoir or a defined nearby location

    Yes / No. Includes water levels, leakage, settlement, and works carried out.

  2. All preliminary, final, inspection, and completion certificates are held on file

    Yes / No. Originals or certified copies, retained for the lifetime of the reservoir.

  3. All inspection reports, safety measure completion certificates, and engineer correspondence are filed and retrievable

    Yes / No.

  4. Records are accessible to the enforcement authority on request

    Yes / No.

What happens if an item fails

Penalty:
<p>Each "no" is a potential offence. Under section 22 of the Reservoirs Act 1975, failure to comply with duties such as appointing engineers, carrying out required safety measures, or maintaining records is a criminal offence triable in the magistrates' court, with fines and, for continuing offences, daily penalties. The Environment Agency and Natural Resources Wales can also serve enforcement notices and carry out works in default at the undertaker's cost.</p>
<p>In Scotland, SEPA can issue civil sanctions including fixed and variable monetary penalties under the Reservoirs (Scotland) Act 2011 in addition to criminal prosecution. In Northern Ireland, DfI can prosecute under the Reservoirs Act (Northern Ireland) 2015 and serve enforcement notices.</p>
<p>Close every "no" with a dated action and a named owner before the next board meeting.</p>
