Management duties 1

Comply with conditions attached to street works permits

If you obtain a permit to carry out work on a street, you must follow every condition the Permit Authority sets – for example limits on which days or times you can work, the exact area you may occupy, traffic restrictions, traffic‑management measures, how the work is carried out, publicising the work and reporting progress. Breaching a condition can lead to the permit being revoked and may expose you to prosecution.

Notify Permit Authority of proposed works within notice response period

If a street‑works notice has been issued about a road you intend to work on, you must make sure you have received that notice and then tell the Permit Authority (or the street authority that issued the notice) about the works you plan to carry out, and you must do this within the response window set out in the notice. Failing to respond in time can mean your permit application is rejected.

Pay fixed penalty notice within 36 days

Fine up to £500

If you receive a fixed penalty notice for breaching street‑works permit rules, you must pay the fine – £500 for a regulation 19 breach or £120 for a regulation 20 breach – within 36 days of the notice. The Permit Authority can extend the payment period if it thinks that is appropriate.

Breach a street works permit condition

Fine up to £2,500

If your company (or a contractor you have hired) does anything that goes against a condition set out in a street works permit, you are committing a criminal offence. On conviction you will be tried in the Magistrates' Court and face a fine of up to £2,500. No prison term is provided for this offence.

Carry out street works without a required permit

Unlimited fine

If you (or a contractor you hire) perform any specified works on a public street without first obtaining the necessary permit, you commit a criminal offence unless the permit scheme says the requirement does not apply. Being convicted leads to a fine that can be unlimited, dealt with in the Magistrates' Court. No prison term is prescribed for this offence.

Fine up to £2,500

When you apply for a permit or provisional advance authorisation for street works, you must also send a copy of that application to the relevant transport authority at the same time. If you do not do this, you commit an offence and can be fined up to £2,500 on summary conviction.
